Employers may be liable to employees for money damages resulting from unpaid overtime. In most cases, when an employee works 40 hours in a single week, any additional hours worked during that week are eligible for overtime pay, which is at least their hourly rate, plus half, for those hours. When employers try to weasel their way out of paying overtime to people who legally earn it, they can be held accountable for mistreating their workers. There are many methods employers use to cheat workers out of their overtime, including

  • Misclassifying them as exempt from OT
  • Classifying them as independent contractors
  • Giving them time off instead
  • Simply not paying at the increased rate
